Condominium: an important stop


By a decision dated September 8, 2010 (Appeal No. 09-15554 ), the Third House Civil Court of Cassation has provided important details about the conditions under which the status of the Condominium may apply.

The Supreme Court has ruled that he can not do not have a condominium in the absence of existence of the common .

This decision is based on Article 1 of the Act of July 10, 1965, which states that the condominium status "governs all buildings built or group of buildings whose ownership is divided among several people, including batch each a unit and a share of common parts ".

The Supreme Court made a strict application of this article.
A reading of the Judgement of September 8, 2010, it now appears necessary to "prove the existence of Public " in order to apply the status of the condominium to a property.
